What is the I-131 Application?

If you’re legally residing within the United States but are not a citizen and want to travel abroad, you may need to obtain a Travel Document before your trip. With Form I-131, also known as the Application for Travel Document, you can obtain a Travel Document that allows you to reenter the United States after leaving it. Form I-131 is used to apply for the following:

  • Reentry Permit
  • Refugee Travel Document
  • Advance Parole Document

In order to obtain a Travel Document, file Form I-131 with the U.S. Citizenship and Immigration Services (USCIS) prior to leaving the United States.

When do I need to file Form I-131, Application for Travel Document?

Legal residents of the United States and those with other immigration statuses can travel abroad and re-enter the country. Form I-131 can provide them with the appropriate documentation to do so. You’ll need to fill out Form I-131 to petition for any of these:

  • Reentry Permit
  • Refugee Travel Document
  • Advanced Parole Document

Reentry Permit

If you’re a green card holder or a conditional resident of the United States, you may need a Reentry Permit to return to the United States. If you intend to leave the country for a year or more, your green card will be treated as invalid upon your return. Your Reentry Permit will be what allows you to reenter the United States.

Refugee Travel Document

If you have refugee or asylum status, you may still travel to and from the United States even if you don’t have a passport. Form I-131 will allow you to obtain a Refugee Travel Document. This will act as your passport and looks similar to one issued by the United States.

Advanced Parole Document

In some instances, those who would otherwise be declared inadmissible to the United States can still reenter the country with an Advanced Parole Document. Some people who may have trouble reentering the U.S. without this document include the following:

  • I-485 applicants
  • U visa holders
  • Adjustment of Status applicants
  • Grant of LIFE Act Family Unity Program beneficiaries
  • Persons with Temporary Protected Status
  • Persons who have accrued unlawful presence

What requirements must I meet to obtain a Travel Document?

Request your Travel Document by filing Form I-131 along with the appropriate supporting documents. In addition to your identification and photographs, you may also have to submit documents proving your status within the United States. The types of documents you’ll submit depend on your purpose for travel and your legal status.

USCIS may also require you to attend a biometrics appointment. If you are traveling with anyone with a derivative status based on your own, they will also need to file Form I-131 and submit the appropriate documentation.

How long does it take to get a travel document?

After submitting your application for a travel document, it should arrive within 150 days. The process may take longer depending on your specific circumstances. You won’t be able to leave the United States until you receive your travel documents, so make plans to remain inside the country for several months after submitting your application.
